1. Corporate Identification

The SUBAXA platform is owned and operated by SUBAXA S.A., registered in San Carlos, Alajuela, Costa Rica.

2. Scope of Services

SUBAXA provides an information, monitoring, and analytical software platform for judicial foreclosures published in the Judicial Bulletin of Costa Rica, along with auxiliary legal due diligence services as defined under active subscription plans.

3. Financial Disclaimer

SUBAXA is not registered as a broker-dealer or investment advisor with the Superintendencia General de Valores (SUGEVAL). Information provided on the platform is intended strictly for research and decision-support purposes. Final investment and bidding decisions rest exclusively with the user.

4. Historical Market Data

Historical returns, comparative spreads, and case metrics reflect past Costa Rican foreclosure market data (2024–2025) and do not guarantee future performance. Each judicial auction is an independent legal proceeding subject to market variance.

5. Subscriptions and Billing

• The Explorer plan is free without ongoing obligation.
• Paid subscription tiers are billed monthly or annually in USD.
• 30-Day Satisfaction Guarantee: full refund within 30 days of initial subscription if unsatisfied.
• Subscriptions may be cancelled at any time via your user account settings.

6. Acceptable Use Policy

Users agree to utilize the platform in good faith, without attempting unauthorized scraping, security circumvention, or unlawful use of proprietary data.

7. Intellectual Property

All platform software, interface designs, trademarks, and synthesized data are the exclusive property of SUBAXA S.A. Public notices originating from the Judicial Bulletin maintain their statutory public domain status.

8. Limitation of Liability

SUBAXA S.A. shall not be liable for capital losses resulting from investment decisions made by the user, except in cases of proven gross negligence or willful misconduct. Maximum cumulative liability is limited to the total fees paid by the user in the preceding 12 months.

9. Amendments

SUBAXA S.A. reserves the right to modify these terms. Subscribed users will receive notice at least 15 days prior to material updates.

10. Governing Law & Jurisdiction

These terms are governed by the laws of the Republic of Costa Rica. Any disputes shall be submitted exclusively to the competent courts of San José, Costa Rica.
